Welcome to our website. These Terms and Conditions ("Terms", "Agreement") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you", "customer", "user") and Ellie Rodgar, operating as a Sole Proprietorship in the State of Illinois ("we", "us", "our"). These Terms govern your access to and use of our website, as well as any purchases of custom-made or made-to-order physical products.

Please read this Agreement carefully before placing an order. By accessing our site or making a purchase, you agree to be bound by these Terms.

1. Custom and Made-to-Order Goods

  • Production and Order Initiation: All products offered on our platform are custom-made or made-to-order. Production on your item(s) will not commence until full payment is successfully processed and cleared via our third-party processor.

  • No Modifications or Cancellations: Because your items are tailored specifically to your order specifications, all sales are final once production begins. You have a strict window of twenty-four (24) hours from the time of purchase to request a cancellation or modification. After 24 hours, orders cannot be cancelled, changed, or refunded.

  • Sizing and Specifications: You are solely responsible for providing accurate measurements, specifications, or preferences when placing an order. We cannot be held liable for ill-fitting or incorrect items resulting from inaccurate information provided by the customer.

2. Pricing, Errors, and Payments

  • Payment Terms: All payments for physical goods must be paid upfront at checkout. We do not accept payment plans or partial deposits unless expressly agreed upon in a separate writing.

  • Third-Party Processor: Payments are securely processed through Stripe. By purchasing, you agree to comply with Stripe’s terms of service. We do not store or collect your complete financial details.

  • Right to Correct Pricing Errors: While we strive for absolute accuracy, errors may occur. In the event that a product is mistakenly listed at an incorrect price (e.g., an item listed for $1 instead of $100), we explicitly reserve the contractual right to cancel, refuse, or revoke any orders placed for that product—even if the order has been confirmed and your payment processed. If your payment has already been processed, we will issue a full refund to your original payment method immediately upon cancellation.

3. Shipping, Delivery, and Risk of Loss

  • Geographic Limits: We only offer shipping and delivery nationwide within the United States. We do not ship internationally at this time.

  • Risk of Loss (FOB Destination): Pursuant to Illinois commercial law, the risk of loss and title for all physical goods passes to you, the buyer, upon delivery of the items to the destination address specified in your order (FOB Destination). We are responsible for items lost or damaged in transit prior to delivery; however, we are not responsible for theft ("porch piracy") or damage that occurs after the carrier marks the package as successfully delivered.

  • Inspection Period: Due to the custom nature of our goods, you must inspect your delivery within forty-eight (48) hours of receipt. Any defects, damages, or deviations from your ordered specifications must be reported to us in writing within this 48-hour window, accompanied by photographic evidence.

4. Intellectual Property Protection

  • Ownership of Material: All content displayed on this website—including but not limited to custom designs, product patterns, images, photographs, text, graphics, logos, and digital arrangements—is the exclusive intellectual property of Ellie Rodgar

  • Prohibited Use: You are strictly prohibited from copying, reproducing, redistributing, mimicking, or creating derivative works of our designs or website content for commercial use without express, written permission from Ellie Rodgar. Unauthorized use may violate federal copyright laws and Illinois state intellectual property statutes.

5. Restrictions on Use and Age Limits

  • No User-Generated Content: This platform does not allow users to upload, post, or host content (such as public reviews, pictures, or comments).

  • Minors Prohibited: Our website and products are not marketed to or intended for purchase by minors. By making a purchase, you represent and warrant that you are at least eighteen (18) years of age and possess the legal capacity to enter into a binding contract under Illinois law.

6. Dispute Resolution, Arbitration, and Venue

  • Governing Law: This Agreement and your relationship with us shall be governed by, interpreted, and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.

  • Mandatory Binding Arbitration: You and Ellie Rodgar agree that any dispute, claim, or controversy arising out of or relating to these Terms, your purchase, or the breach, termination, enforcement, interpretation, or validity thereof, will be resolved exclusively by binding, individual arbitration, rather than in court. You explicitly waive your right to participate as a plaintiff or class member in any purported class action lawsuit or representative proceeding.

  • Forum Selection / Venue: In the event that any dispute is legally permitted to proceed in a courtroom (such as small claims matters), both parties agree that all legal proceedings must be brought exclusively in the state or federal courts located in Cook County, Illinois. You hereby consent and waive all objections to lack of personal jurisdiction and forum non conveniens.

7. Limitation of Liability

  • To the maximum extent permitted by Illinois law, Ellie Rodgar shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or the inability to use our custom products, even if advised of the possibility of such damages. Our total liability to you for any claim arising from a purchase shall not exceed the total purchase price paid by you for the specific item in dispute.
